IS CBD EVEN LEGAL?


Because CBD is shifting the cannabis conversation to the mainstream, questions come up about whether or not CBD is even legal.


Firstly, yes, CBD is legal in all 50 states in the United States. Changes introduced in the 2018 Farm Bill made it so that CBD derived from hemp with a THC content of no more than 0.3% is legal for production and use. Anything above 0.3% THC is considered non-hemp cannabis, or marijuana, and subject to federal punishment.


States like California and Colorado where marijuana is legal are allowed to use CBD derived from the marijuana plant and can have blended skincare products that are in ratios like 1:1, 1:3, etc. For everyone else selling CBD in states where only CBD is legal, only hemp-derived CBD-based products with 0.3% or less THC is permitted.
